CHARMED-EMAIL TERMS OF SERVICE
Charmed~Email is a Tier 1 & 2 site open to citizens of Australia, Austria, Belgium, Canada, Denmark, Finland, France, Germany, Greece, Iceland, Italy, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom, and United States.
NO NEW SIGN UPS from any Tier 3 or 4 country is allowed.
~RESPONSIBILITY OF AFFILIATES
You must be 16 years of age or older to become a Charmed~Email affiliate.
You are required to use your own name and email address in any and all features of the Charmed~Email program. Failure to do so could result in the termination of your account, forfeiture of all earnings and benefits in said account and possibly even legal action.
You may have only 1 Charmed~Email account.
New members must click at least 5 links within one week of sign up to activate your account. Failure to do so will result in account cancellation. Thereafter a minimum of 50 clicks per calendar month are required to maintain your account. Although there is a 5 cent bonus for sign up, we ask that new members earn enough by personally clicking ads to cover their first ad submission.
You may not use the same computer as any other Charmed~Email affiliate without prior authorization from admin.
You may not use the same payment account as any other Charmed~Email affiliate. Both members will lose their accounts and all earnings and benefits associated with them.
You may not log into Charmed~Email using any other account but your own without prior consent from admin.
Vacation mode may be set for a maximum of 30 days no more than twice per calendar year unless arrangements have been made with the webmaster. As long as you have 50 clicks within the calendar month, it is not necessary to put your account on vacation.
Your personal information, including your Charmed~Email user id and password are your responsibility. They can be changed by logging into your Charmed~Email account and clicking on Profile.
Any instances of fraud are grounds for immediate termination of your Charmed~Email account and all earnings and benefits within it. If the incident involves having more than one account, Charmed~Email reserves the right to file charges for recovery of any earnings paid out to any account involved.
Any forms of system abuse are punishable by the means set forth by Charmed~Email on a per instance basis. These punishments may include loss of earnings, loss of downline, termination of your account and even legal action. All punishments will be set forth depending on the form of abuse involved in the circumstance.
Your Charmed~Email is non transferable. You may not sell, trade or give away your Charmed~Email account or anything in it without prior consent by admin. This includes: downline, earnings, your account info, any pages accessible only by Charmed-emails affiliates and any benefits that are issued to you as an affiliate. Any violation of this term will result in immediate termination of your account and forfeiture of all earnings and benefits that go with it.
You must maintain a valid email account. You agree to receive emails from Charmed~Email to this email account. You agree to keep your email account up to date and notify Charmed~Email if it should change. You agree to keep you email account in working order and tended so that emails do not start being returned. You agree to not use an autoresponder to send mails to Charmed~Email. You agree to communicate with Charmed~Email in English and to not send us spam.
~ RELATIONSHIP OF PARTIES
You and Charmed~Email are independent contractors. Nothing in this agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between the two of us. You agree that you do not have the authority to make or accept any offers or make any representations on behalf of Charmed~Email. You may not make any statement, whether on your site or otherwise, that would contradict anything in this agreement. You are solely responsible for the reporting and payment of any taxes for money earned while using this program.
~ PAYMENTS
Affiliates may earn by clicking the links provided by Charmed~Email both inside their Charmed~Email account and in select emails sent to their email addresses by Charmed~Email. You may earn by referring other affiliates using the link provided to you by Charmed~Email. You may also earn through other activites provided at times by Charmed~Email.
Charmed~Email will pay affiliates when their balance reaches the minimum payout of $3.00, not to exceed this amount and only this amount per request. When the affiliate has obtained enough earnings in their Charmed~Email account, the affiliate may request payment. Affiliates will be paid by paypal, alert pay, or Amazon gift card. If you request Amazon gift card, you may hold your earnings up to $10 before requesting payment. Once an affiliate requests payment, their account will be reviewed. If, after their review, their account is in good order, they will be paid within 30 days of their request date, or as funds allow. Members from Tier 3 & 4 countries may only redeem for advertising unless they have a paid upgrade or arrangements have been made with admin.
The Foreign Assets Control Policy by the United States will not permit payments to or payments from members of the following countries: Angola, Burma, Cote d'Ivoire, Cuba, Iran, Iraq, Liberia, Libya, North Korea, Sierra Leone, Sudan, Syria, Western Balkans (Bosnia & Herzegovina, Albania, Macedonia, Serbia and Kosovo) and Zimbabwe
~ AFFILIATE PAGE CLAUSE
Charmed~Email is not a paid to promote site. We are a paid to read/click site. Therefore, you MUST be active in the paid to read/click areas of Charmed~Email in order to earn from the affiliate page feature(s). Anyone caught abusing this feature will have these privileges suspended. In order to request payment you must have a minimum of 5% earnings other than downline and affiliate page earnings, and must have clicked a minimum of 50 links per calendar month. This means for every dollar you have in affiliate page and downline earnings, you must have 5 cents in personal earnings from other areas of the site. This rule applies to every member including other site owners. I click on other sites and observe the rules so I appreciate my members following this simple rule. Affiliate Pages CANNOT be put in some surf (click) exchanges or ptc surf (click) exchanges. Please contact admin for approval. Repeated use of non allowed sites will result in your affiliate page being suspended.
~ INACTIVITY
ALL members must click at least fifty (50) links per calendar month to remain active. If you fail to do this two (2) months in a row, your free upgrade will be permanently removed. Upgraded members or those using any paid to promote feature of the site must click at least fifty (50) links per calendar month to remain active and request payout. This also applies for bonus ads sent to be placed on our site. If the required 50 links have not been clicked in the last calendar month, then their bonus ads will not be accepted for processing.
~ CHEATING
Charmed~Email does not tolerate cheating of any kind.
1) Using click software or click bots results in immediate forfeiture of account and all associated earnings and benefits.
2) Checking any of the following in your profile: bot user, don't read, can't understand English, and/or I cheat will result in immediate cancellation of your account.
3) Clicking more than one link at a time alerts my anti-cheating bot software and your IP is recorded as a cheater. If you are not using cheating software, but are clicking ads without completing the viewing time, it is considered a bad turn. More than 5 bad turns per month will result in account suspension.
4) Having more than one account will result in immediate forfeiture of account and all associated earnings and benefits.
5) If your personal information is incomplete, name, address, pay account, and you have not corrected it after receiving a personal admin, then it will result in account suspension.
6) Failing an English test will result in suspension of your account.
7) Promotion or instruction on or of how to cheat will result in immediate forfeiture of account and all associated earnings and benefits.
8) Trying to receive credit for a paid to join and not actually joining the program will result in suspension.
9) Putting links in the Charmed~Email database that are against terms will result in cancellation.
10) Failing an english test will result in suspension.
11) Stating negative comments about Charmed~Email or any of it's admin or members while you are a member of Charmed~Email.
12) There is a cheat link imbedded in every email sent out. Clicking this cheat link will result in 50 cents immediately taken from your account. Click 3 of these cheat links and your account will be cancelled. This is a paid-to-read site, so if this link is clicked you are not reading. I understand mistakes are made, so if you accidentally click one of these links and notice it right away, please contact me. I will consider correcting the cash lost.
~ ADVERTISING TERMS
-- The website must not contain pornographic, racist, discriminating, vulgar, illegal, or other adult materials of any kind.
-- The website must not contain any frame breakers.
-- The website must not contain or promote any viruses
-- The website must not conatin ANY prompts such as download dialogs or confirmation alerts.
-- The website must not exceed the 1 popup/popunder limit and must not open any new windows.
~ LIMITATION OF LIABILITY
Charmed~Email will not be held liable for lost profits, lost business opportunities or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this agreement or any other part of the Charmed~Email program even if Charmed~Email has been advised of the possibility of such damages. Charmed~Email aggregates liability arising under this agreement will not exceeed the amount of the total fees paid or payable to you under this agreement. The provisions of all terms listed on this page survive termination or expiration of this agreement.
~ SPAM
You may not promote you referral links through unsolicited emailing, newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate loss of your Charmed~Email account and forfeiture of all earnings and benefits associated with said account and may also result in legal prosecution. Charmed~Email strictly upholds the anti-spam laws. Charmed~Email will cooperate fully with any authorities and investigations that may arise from any incident of spam. We also reserves the right to charge up to $5 per spam e-mail sent.
~ SUBJECT TO CHANGE
Any of the above listed terms, rules, and agreements may be amended at any time. We will make every effort however, to inform our members of any change in terms.
~ Charmed~Email is NOT a MLM or marketing pyramid of any sort. By joining and participating in Charmed~Email you agree to all terms set forth in this agreement. Charmed~Email may, at any time, choose to edit, add to or delete from this agreement in part or in its entirety at any time without prior notification to its affiliates. Affiliates will be notified of any and all such changes. If you do not agree with any changes made you may cancel your membership with Charmed~Email. By remaining a member of Charmed~Email afer notification of any changes, you enter into a binding agreement of acceptance to said changes.
